Combating Spoofing and Robocalls

The Federal Communication Commission’s (FCC’s) Notice of Proposed Rulemaking (NPRM) would allow the agency to further protect consumers from caller ID spoofing and illegal robocalls by prohibiting unwanted and unwarranted calls and texts messages from a sender outside of the United States.  The NPRM would implement legislative changes to the Truth in Caller ID Act, a rule which made it unlawful to use inaccurate caller ID info (“spoofing”). Amendments were first introduced by the RAY BAUM’S Act of 2018 which expanded the rule to texts messages and international calls.

The NPRM proposes to expand caller ID spoofing rules by including texts or calls from outside of the U.S. to recipients in the US, as well as adding the phrase “in connection with any voice service or text messaging service” to the Truth in Caller ID Act in the case of “any caller identification service to transmit or display misleading or inaccurate caller identification information.” The proposal also invites commentary on adopting definitions of “text message,” “text messaging service,” “voice service,” “caller identification information,” and “caller identification service.”
