The FTC recently submitted a staff comment to the FCC regarding proposed amendments to FCC regulations limiting robocalls to consumers. The amendments raise concerns for consumer protection among FTC staffers, implementing new changes in laws allowing robocalls to collect debt owed to the federal government without a consumer’s prior consent. The FTC comment advises the creation of government debt collecting standards that are consistent with other FTC enforced laws.

The comment also proposes the limitation of robocalls to individuals about debts in default, to those who actually owe the debts, to solely collect government debt, and for collection purposes only. The comment also recommended that the FCC institute data security practices concerning information attained during calls. It suggests limiting the use of said data to debt collection, and the restriction of calling-times to remain consistent with the Fair Debt Collection Practices Act (FDCPA).

The comment supports the FCC’s proposal allowing consumers to stop undesired debt collection robocalls, suggesting requirements for the transmission of caller’s ID information containing a number that connects to live representative of the collector.
